Sound Familiar?
Every day, individuals and businesses in Kenya face legal challenges that cost them time, money, and peace of mind. Here is how Gracen Law fixes them:
“Building the product before knowing whether it needs a licence”
We establish the regulatory perimeter first — which regulator, which category, or whether a partner's licence covers it.
“A licence application stalling on a generic AML programme”
The AML framework is built to be assessed as part of the application, because that is when regulators test it.
“Missing the 4 November 2026 virtual asset transition deadline”
We map the CBK and CMA split for your activities and run the authorisation to the deadline rather than past it.

We are a commercially focused firm advising entrepreneurs, corporates, investors and families across Kenya. Every mandate is supervised by a senior advocate, and you are told at the outset who is responsible for your file.
Since the Virtual Asset Service Providers Act, 2025 commenced on 4 November 2025, virtual asset activities require authorisation. The CBK supervises wallet custody, payment processing and stablecoin issuance; the CMA supervises exchanges, brokerage, investment advice, asset management and token offerings. A business spanning both may need two licences, and the regulations set a transition deadline of 4 November 2026 for firms already operating.
It depends on what the business does with customer funds. The National Payment System Regulations, 2014 provide distinct categories — electronic retail payment service provider, designated payment instrument issuer, e-money issuer and small e-money issuer — with materially different obligations. Some businesses discover they need no licence at all because the regulated activity sits with a partner bank or licensed PSP.
Under POCAMLA a reporting institution must conduct customer due diligence, keep prescribed records, monitor transactions and report suspicious transactions to the Financial Reporting Centre, as well as appoint a compliance officer and train staff. For a licence applicant this is not a post-authorisation task — the AML framework is assessed as part of the application, and a generic programme is a common reason an application stalls.
