Estate and Succession Support

Connect family intentions, ownership and the authority to act.

When a family estate involves Kenyan assets and beneficiaries living abroad, important decisions can become difficult to coordinate. Gracen Law supports diaspora families with succession planning, estate document review and administration work organised around the assets, representatives and decisions involved.

The mandate can help you prepare for future succession or address an estate that already requires action. We establish the available records and authority, identify the legal work needed and coordinate relevant advisers where assets or family connections span several countries.

Give the family a clearer legal pathway

A will, company shareholding and property title may each describe a different part of the family’s wealth. An effective succession plan considers how those arrangements work together and whether the intended beneficiaries, decision makers and management responsibilities are clearly recorded.

For an existing estate, the starting point is its actual position: the documents available, authority of representatives, assets identified and matters still unresolved. We distinguish administration work from contested issues and define the steps needed for the next stage, including any formal documents or local attendance required.

What your mandate can cover

  • Wills, beneficiary intentions and the ownership of relevant property, investments and business interests.
  • The authority and responsibilities of executors, administrators and other representatives.
  • Estate records, supporting documents and the legal steps required for administration.
  • Family business continuity, trusts and holding arrangements connected to succession.
  • Coordination with relevant advisers for assets and issues in other markets.
  • Written advice and reporting on outstanding documents, decisions and next actions.

Estate and Succession Support

Choose the support your family needs

01

Succession planning and document review

Review the assets, existing wills and family intentions before developing the agreed planning documents. The work identifies how ownership, governance and intended inheritance should connect, with tax or financial advice coordinated where needed.

02

Estate position and administration mandate

Establish the stage reached, representative authority and outstanding estate work. The scope can cover document preparation, advice, local coordination and communication with authorised representatives through the agreed administration process.

03

Family business and cross-border estate coordination

Connect company interests, delegated management and assets in several markets. We identify the legal workstreams and advisers required so the family can direct a coherent mandate while responsibilities remain clear for each part.

Questions

Frequently asked questions

Can I instruct you while living outside Kenya?

Yes. Advice, meetings, document review and reporting can be organised remotely. The mandate identifies any original records, formal execution or local steps required. It also records who can instruct the team and receive information so the estate work follows clear authority.

Can you review an existing will rather than start again?

Yes. We can assess the document against your current ownership, family intentions and business interests, identifying questions or changes that need attention. Where other markets are connected to the arrangement, relevant advice should be coordinated before implementing an updated succession plan.

Can you help with an estate already being administered?

We first review the available administration documents, representative authority, assets and stage reached. This establishes the outstanding work and whether a defined further mandate can progress it. Existing representatives and advisers can remain involved within agreed responsibilities and communication arrangements.

What if beneficiaries disagree?

We assess the issue and available records before recommending the appropriate scope. A disagreement may require negotiation or a separate dispute strategy alongside administration. The engagement distinguishes those workstreams so routine estate coordination is not mistaken for resolution of a contested claim.

How are assets in different countries handled?

The work identifies the location and form of relevant assets and the advice required in each connected market. Adviser responsibilities and document dependencies are coordinated within the mandate. This helps the family consider a coherent plan without assuming every asset follows one process.
