The Legal Problems Our Karen Clients Face — Solved

Every day, individuals and businesses in Karen face legal challenges that cost them time, money, and peace of mind. Here is how Gracen Law fixes them:

01

“A dismissal with a good reason overturned on procedure”

We design the process before the decision is taken — allegations, hearing, right to be accompanied, contemporaneous record.

02

“A redundancy that is commercially genuine but legally unfair”

Selection criteria set before individuals are chosen, with notification, consultation and severance handled to the statutory requirements.

03

“Personal criminal exposure from unremitted SHIF or NSSF deductions”

We audit the statutory payroll position, which carries a fine of up to KES 2 million or imprisonment and is usually left entirely to payroll.

Are initial consultations at Gracen Law free?

No. Gracen Law charges a consultation fee, which we confirm with you before your first meeting so there are no surprises.

Why choose Gracen Law for labour law firm in karen?

We are a commercially focused firm advising entrepreneurs, corporates, investors and families across Karen. Every mandate is supervised by a senior advocate, and you are told at the outset who is responsible for your file.

What makes a termination fair under Kenyan law?

Two things, and both are required. There must be a valid reason — conduct, capacity, compatibility or operational requirements — and a fair procedure must be followed: notifying the employee of the allegations, holding a hearing, allowing them to be accompanied, genuinely considering the response, and recording the decision at the time. Employers most often lose on procedure while being entirely right on the reason.

What are our SHIF obligations as an employer?

Since October 2024 you must register with the Social Health Authority, register your employees, deduct 2.75% of each employee's monthly gross salary and remit by the 9th of the following month. The minimum is KES 300 per month with no upper limit. Late payment attracts a 2% penalty, and failing to remit or making unauthorised deductions carries a fine of up to KES 2 million or up to three years' imprisonment. From 2026 SHIF is deducted before PAYE.

Can we engage people as contractors instead of employees?

You can, but the label does not decide it. Kenyan courts look at the substance: control over how and when the work is done, integration into the business, whether a substitute can be sent, who provides the tools, and whether the person bears commercial risk. If the relationship has the characteristics of employment it will be treated as employment, with back-dated statutory contributions and potential unfair termination exposure.

Employment & Labour Most employment claims in Kenya are not lost on the decision. They are lost on the procedure followed to reach it — and procedure is the part an employer can control entirely.
