“Paying a deposit against a title nobody independently verified”
Official searches and proprietor verification before any money moves — the step most often compressed, and the one that most often prevents a loss.
“A transaction voided because Land Control Board consent was never obtained”
We establish whether the land is controlled at the outset and obtain consent within the statutory period.
“Budgeting 2% stamp duty on land now gazetted as urban at 4%”
We confirm the band and the government valuation early, so the acquisition budget reflects what will actually be assessed.

An official search at the land registry confirming the registered proprietor and any encumbrances; verification that the person dealing with you is that proprietor or holds a valid power of attorney; confirmation there is no caution, restriction or charge; a physical site visit against the deed plan; rates and land rent clearance; and, for agricultural land, Land Control Board consent. Deposits paid before these are complete are the most common way buyers lose money here.
Four per cent of the government-assessed value for land in urban areas and two per cent for rural land. The Council of Governors gazetted a list of urban areas on 4 April 2024, moving many locations from the two per cent band to four. Since 16 February 2026 stamp duty is assessed and paid exclusively through the ArdhiSasa National Stamp Duty Module — land registries no longer accept physical submissions.
Only on leasehold tenure, for a term not exceeding 99 years, under Article 65 of the Constitution. Any instrument purporting to grant more takes effect as a 99-year lease regardless of its wording. The restriction extends to companies: a company counts as a citizen only if wholly owned by Kenyan citizens, so a foreign-owned Kenyan company is in the same position.
