Employee Advice and Separation

Being asked to sign a new contract, attend a disciplinary hearing or leave a job raises questions that are hard to answer from the inside. We advise individual employees on their contract, their position at work and the terms on which employment ends.

Overview

The firm also advises employers, so we run a conflict check before accepting an instruction.

When employees come to us

  • You have been asked to sign a new contract or accept changed terms
  • You have been invited to a disciplinary or redundancy meeting
  • You have been offered a separation agreement
  • You believe your dismissal was unfair

Dismissal, redundancy and separation

A fair termination under Kenyan law needs both a valid reason and a fair procedure. Procedure means being told the allegations in a form you can respond to, a hearing, the chance to be accompanied by a colleague or union representative, and a genuine consideration of your response.

A separation agreement usually means giving up claims in return for payment, so it is worth understanding what you would be giving up before you sign.

Executive transitions

Senior executives often have more at stake than salary: bonus and equity, notice periods, restrictive covenants and how a departure is announced. We advise on these terms and on negotiating an exit that leaves your next role open.
