Sound Familiar?
Every day, individuals and businesses in Muthaiga face legal challenges that cost them time, money, and peace of mind. Here is how Gracen Law fixes them:
“The family business losing signing authority the moment the owner dies”
A registered family trust holds the shares continuously, so there is no administration gap and no grant needed for trust assets.
“Setting up a trust and receiving none of the tax reliefs”
We register the trust through the Principal Registrar of Documents — registration is what unlocks the stamp duty, capital gains and income tax exemptions.
“A will that excludes a dependant and invites a court challenge”
We plan around the dependant provisions in the Law of Succession Act rather than ignoring them and hoping.

They do different jobs and many families need both. A will directs who inherits but operates only on death, and the estate must still be administered before anything transfers — which leaves a business without clear signing authority in the meantime. A registered family trust holds assets during your lifetime and continues afterwards, so there is no interruption and no grant required for the trust assets.
Because the tax reliefs attach to registered family trusts specifically. Under the Trustees (Perpetual Succession) (Amendment) Act, 2021 you apply for incorporation through the Principal Registrar of Documents, who must approve or reject within 60 days. Registration brings exemption from stamp duty and capital gains tax on transfers into the trust, income tax exemption on trust income, and beneficiary income exempt up to KES 10 million a year. An unregistered trust attracts none of that.
Not without qualification. The Law of Succession Act allows dependants who have not been left reasonable provision to apply to the court, and the court can vary the distribution. Dependants are defined more broadly than most people assume, so a will that simply excludes someone with a genuine claim tends to invite litigation rather than prevent it.
